We assume that as a client of Denkyem, you have read and agreed to our terms and conditions before requesting our services. Denkyem reserves the right to amend or remove parts of its Terms and Conditions from time to time. Such changes will be posted on www.denkyem.com. Identity

 

Denkyem International Consulting is a formally registered tradename of Rift Valley African Investements b.v., Amsterdam, the Netherlands.

Denkyem International Consulting is registered at the Amsterdam Chamber of Commerce (KVK) under number 24418232.

1. Data Subjects

 

Denkyem International Consulting b.v. is hereafter referred to as DENKYEM.

DENKYEM processes personal data of the following categories:

•Identified third party infringers of intellectual property rights of our clients (hereafter: infringers), i.e. name, address, email address, company details. DENKYEM does not process date of birth, social security numbers or bank account numbers of infringers.

•Employees. This data contains names, addresses, email addresses, birth days, social security numbers and bank accounts numbers.

•Partners (third party (sub)contractors, associated law offices). This data contains names, addresses and email addresses.

•Authorities (e.g. Police, Customs, Federal Public Service). This data contains names, addresses and email addresses.

•Clients of DENKYEM. This data contains names, addresses and email addresses.

•Job applicants. This data contains names, addresses, email addresses and date of births.

 

2. Processing Purposes

 

Necessity

Processing the data of infringers is necessary to monitor infringement cases and register the recidivists/ multiple offenders, in order to be able to protect and enforce the intellectual property rights of our clients.

 

Source

We obtain the infringers’ data through Customs notifications, police information, online research (Whois information, websites of infringers) and the infringers themselves.

 

Accessibility

All employees of DENKYEM can access the personal data of the infringers. Counterfeit trade is typically crossing borders including those of the EU. In order to enhance the protection of IP rights, disclosing international trade patterns of fake products is an important objective of DENKYEM.

 

Period

The infringers’ personal data will be deleted after a process period of 10 years, unless there is a contractual relationship between DENKYEM and the infringer or other particular circumstances that legitimise a longer period of processing.

 

Third parties

The infringers’ personal data will only be shared with a third party when used for the same purpose of DENKYEM, i.e. to protect and enforce the intellectual property rights of our clients, or when obliged to by law. DENKYEM will not sell the infringers’ personal data to third parties.

 

3. Right of Inspection and Correction

 

Upon request by the subject of the information, DENKYEM will provide insight in the processed personal data of an infringer. The infringer may file a substantiated request to have the data rectified or deleted. Our privacy officer will evaluate such request and respond within three weeks.

 

4. Security

 

Our computers and software are secured in accordance with standard business security practice. Our employees are trained to use data in compliance with our Data Use Policy.

 

5. Breach of Data

 

In case of a breach of personal data, DENKYEM’s Privacy Officer will notify the local data authorities within 72 hours after having become aware of it.
